1About us and these terms

ClearyKeys is a trade name of Lorcan Cleary, a sole trader in Amsterdam registered with the Netherlands Chamber of Commerce (KvK) under number 90984757. In these terms, “we” and “us” mean Lorcan Cleary trading as ClearyKeys, and “you” means the person using the app or this website.

These terms apply to the ClearyKeys app and to clearykeys.com. By using either, you agree to them. Premium subscriptions are also covered by our subscription terms, and how we handle personal data is set out in our privacy policy.

2Using ClearyKeys

We give you a personal, non-exclusive and non-transferable licence to use ClearyKeys on devices you own or control, for your own practice and study. Teachers are welcome to use it in their lessons, for example to show a student an exercise or to generate a sight-reading piece together.

ClearyKeys is downloaded from Google Play, so the Google Play Terms of Service also apply to the download and to any purchase.

3Age

Pianists of every age can use ClearyKeys. If you’re under 18, you need a parent’s or guardian’s permission to subscribe to Premium, and they should read these terms with you.

4Premium

Every tool in ClearyKeys can be used for free. Premium is an optional subscription at €4.99 a month or €49.99 a year, including VAT, with the first 7 days free. It renews automatically until you cancel, and you can cancel at any time in Google Play. The full details, including the free trial, renewal, refunds and your right of withdrawal, are in the subscription terms.

5Your data and recordings

Your pieces, plans, practice history and recordings are yours. They’re stored only on your device, which means we can’t restore them if your phone is lost, reset or replaced.

Use Settings → Your data → Save a backup to keep a copy. A backup includes everything except recordings, which you can save separately as MP3 files with Premium.

6Practising safely

The Practice Lab and the rest of ClearyKeys offer practice approaches and exercises. They are not a medical diagnosis or treatment. Take breaks, and stop playing if something hurts. If pain, numbness or tension keeps coming back, see a doctor or a physiotherapist who works with musicians.

7What you may not do

• copy, sell, rent or pass on the app or its content
• get around the Premium check, or help others to
• take the app apart or copy its code, except where the law allows it
• use ClearyKeys or its content to build a competing product

If you seriously or repeatedly break these rules, we may end your licence to use the app.

8Ownership

The app, its text, exercises, courses and design, the name ClearyKeys and the ClearyKeys logo belong to Lorcan Cleary. Sight-reading pieces are generated by the app for you, and you’re free to print and use them in your own practice and teaching.

ClearyKeys also uses material shared under open licences, such as its piano sound and typefaces. These are listed with their licences on our credits page.

9Our responsibility to you

We work to make ClearyKeys accurate and reliable. As a consumer, you have legal rights if the app or Premium doesn’t work as described, and these terms don’t limit them.

As far as the law allows, we aren’t responsible for indirect loss, or for practice data lost because it wasn’t backed up. Our total responsibility to you is limited to what you paid for Premium in the 12 months before the claim. None of this limits our responsibility for loss caused by our intent or gross negligence, or anything else the law doesn’t allow us to limit.

10Updates, changes and ending

We update ClearyKeys to fix problems and add features, and some updates may be needed to keep using it.

You can stop using ClearyKeys at any time by cancelling any subscription and deleting the app.

If we change these terms, we’ll update the date at the top. If a change matters to you, we’ll tell you in the app before it takes effect. If you don’t agree with a change, you can cancel and stop using the app.

11Law and disputes

These terms are governed by Dutch law. If you’re a consumer living elsewhere in the EU, you also keep the protection of the mandatory consumer laws of your own country, and you can bring a claim in the courts where you live.

If something goes wrong, please email us first. Most problems can be sorted out quickly.
